Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Safe Check App mobile application and related services (collectively, the "Service") operated by Safe Check App ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you represent that you have parental or guardian consent. You must provide accurate information when creating an account.

2. The Service

Safe Check App lets you share your last known location with people you approve through encrypted, invite-only connections. The Service is intended for personal safety and peace of mind — not for commercial tracking, workforce surveillance, or stalking.

We may modify, suspend, or discontinue features with reasonable notice where practicable.

3. Your account

  • You are responsible for your username, device security, and recovery key
  • Keep your recovery key safe — losing it may prevent account recovery
  • Do not share your account credentials or impersonate others
  • Notify us promptly of unauthorized access at privacy@safecheck.me

4. Acceptable use

You agree not to:

  • Use the Service to harass, stalk, or monitor someone without their knowledge and consent
  • Share location data obtained through the Service with unauthorized third parties
  • Attempt to bypass encryption, access others' data without permission, or probe our systems
  • Use the Service for any unlawful purpose or in violation of applicable laws
  • Reverse engineer, scrape, or resell the Service except as permitted by law
  • Upload malware or interfere with the Service's operation

You are solely responsible for obtaining consent from anyone whose location you view and for how you use location information shared with you.

5. Location and permissions

The Service requires location permissions to function. Background location is optional and controlled by you. Location accuracy depends on your device, environment, and network. We do not guarantee real-time or continuous tracking. The Service provides last-known-location sharing, not emergency services dispatch.

Safe Check App is not a substitute for emergency services. In an emergency, call your local emergency number (e.g., 911, 112).

6. Connections and sharing

Sharing is based on mutual trust requests and invites. You may revoke access at any time. We are not responsible for how other users act on information you share or they share with you.

7. Intellectual property

The Service, including software, design, trademarks, and content (excluding your data), is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LOCATION DATA WILL BE ACCURATE OR TIMELY.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from your misuse of the Service, violation of these Terms, or infringement of others' rights.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, provisions that by nature should survive will remain in effect.

13. App Store and Google Play

If you downloaded the app from the Apple App Store or Google Play Store, additional terms from those platforms apply. Apple and Google are not parties to these Terms and are not responsible for the Service. For Apple users: these Terms are between you and us only, not Apple; Apple has no obligation to provide maintenance or support; Apple may refund the purchase price if applicable under Apple's policies.

14. Governing law

These Terms are governed by the laws of Estonia, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country apply. Disputes shall be resolved in the courts of Estonia, unless your local law requires otherwise.

15. Changes

We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
